Staff Analysis of the Legislation

            This bill would amend Part 3 of Article 16 of Chapter 20 of the O.C.G.A. to authorize public and private schools to stock a supply of epi-pens if a prescription has been issued.   An employee or agent would be responsible for storage, maintenance and distribution of the epi-pens stocked by the school. Once an employee or agent has been appropriately trained, he/she would be able to:

1.      Provide an epi-pen to any student or employee whom the designated employee or agent believes is suffering from an anaphylactic adverse reaction;

2.      Administer the epi-pen in accordance with a standing protocol from the prescribing licensed physician;

 

The school would be able to enter arrangements with drug suppliers to obtain the epi-pens free or at a reduced price. The SBOE would have to adopt regulations no later than July 1, 2013. School personnel who administers or chooses not to administer an epi-pen would not be liable, nor would the licensed practitioner who prescribes the epi-pens.
